The US Environmental Protection Agency (EPA) has been hammered with lawsuits from all sides following the release of its mandatory greenhouse gas reporting rule in 2009. Eight separate lawsuits against the Agency’s reporting rule were consolidated under the banner of the American Chemistry Council. The groups the Council represented sought to change certain monitoring and reporting requirements in some fertilizer and chemical facilities, oil refineries, and natural gas centres. The EPA agreed to propose modifications, which satisfied the plaintiffs.
On the other side of the table, the Environmental Defense Fund sued the EPA to try to force the inclusion of eleven industrial sectors that have been exempted from the mandatory reporting rule. That suit has yet to be settled.
